1. Who can apply
The makers program is open to independent craftspeople and small workshops who make products by hand, are at least 18 years old, and can issue business invoices (for example as a registered sole proprietor, self-employed person or small company).
2. Submission and selection
Makers apply by sending photos or videos of their work, a short introduction and their location. Submitting work creates no obligation for either side. We may ask for samples before deciding. We may decline any submission without giving reasons.
3. Supply agreement
Before any product goes on sale, we sign a written supply agreement covering the products and specifications, the fixed payout price per item, quantities and production lead times, packaging requirements, and the fulfilment model (direct dispatch by the maker or bulk shipment to our hub), including who pays which shipping costs.
4. Pricing and payouts
- The maker receives the fixed payout price per item agreed in writing. Kivix Commerce OÜ sets the retail price in its stores.
- Payouts are made according to the agreed schedule after verified fulfilment, against the maker's invoice.
- Makers are responsible for their own taxes and social contributions.
5. Quality and specifications
Products must match the approved samples and agreed specifications. Defective or non-conforming items are handled as set out in the supply agreement (for example replacement, repair or no payout for that item).
6. Product safety and legal compliance
The maker confirms that the products are safe and legal to sell in the European Union and in the other markets agreed. Depending on the product, specific EU rules may apply, for example:
- General product safety: Regulation (EU) 2023/988 (GPSR).
- Cosmetics such as handmade soap, balms and creams: Regulation (EC) No 1223/2009, which requires a safety assessment, a responsible person and notification in the EU CPNP portal before sale.
- Jewellery and metal items: REACH limits on nickel, lead and cadmium.
- Candles: safety labelling according to EN 15494.
- Toys: the EU toy safety rules and CE marking.
- Items that touch food: Regulation (EC) No 1935/2004.
- Textile products: fibre composition labelling under Regulation (EU) No 1007/2011.
We help identify which rules apply, but the maker provides the materials information and documentation needed.
7. Intellectual property and attribution
- The maker keeps all intellectual property rights in their designs and works. We never reproduce, mass-manufacture or license them elsewhere.
- The maker grants Kivix Commerce OÜ a non-exclusive, royalty-free permission to use the maker's name, story, photos and product media to present and sell the agreed products during the agreement, and afterwards only for products already sold or in stock.
- Every product page credits the maker as the creator.
8. Customers, returns and exchanges
Kivix Commerce OÜ is the seller to customers and handles payments, customer questions, returns and exchanges. Costs of returns caused by product defects attributable to the maker are handled as set out in the supply agreement.
9. Exclusivity
Participation is non-exclusive. Makers remain free to sell their work elsewhere unless a specific exclusivity is agreed in writing.
10. Term and termination
Either party may end the cooperation with the notice period in the supply agreement. Remaining stock and pending orders are settled as agreed in that contract.
11. Liability and governing law
Each party is liable for its own obligations under the supply agreement and the law. These terms are governed by the laws of the Republic of Estonia. Contact: general@kivixcommerce.com.
